Justice Dietz's opinion on Griffin case is right on the money

After the public outcry yesterday over the N.C. Supreme Court’s decision to hear Judge Jefferson Griffin’s election challenge case, a few justices decided to more clearly explain their reasoning.
Justice Richard Dietz’s short opinion absolutely nails it. He argues that the State Board of Elections rules underlying the case are unconstitutional and should be challenged. But doing so after an election in an attempt to reverse the result is improper and risks the integrity of the court system.
“[A]s elections draw near, judicial intervention becomes inappropriate because it can damage the integrity of the election process … The petition is, in effect, post-election litigation that seeks to remove the legal right to vote from people who lawfully voted under the laws and regulations that existed during the voting process.”
